Terms of Service and Access to the UzCloud Platform
These Terms of Service and Access to the UzCloud Platform (hereinafter — the 'Terms') govern the use of cloud services on the Internet by individuals and legal entities, as well as persons who are participants in civil law relations conducting business or other activities without forming a legal entity (hereinafter — the 'User').
I. General Terms
1.1. Uzbektelecom JSC (hereinafter — the 'Provider') provides the User with access to the Platform in accordance with these Terms.
1.2. Services are provided on a paid basis in the manner established by these Terms.
1.3. For individuals, acceptance of the Offer is registration on the Provider's portal (uzcloud.uz) and verification via MyID.
1.4. Legal entities receive services on the basis of a contract concluded in electronic form.
II. Key Terms and Definitions
- 2.1 Acceptance — the response of the person to whom the offer is addressed, confirming its acceptance (signing the Agreement).
- 2.2 Offer — a proposal to enter into a transaction that sets out the essential terms of the agreement, addressed to a specific person or an unlimited number of persons.
- 2.3 Public Offer — an agreement between the Provider and the User governing the terms of access to the UzCloud service.
- 2.4 Platform — a set of UzCloud cloud services: virtual servers, file storage, application platforms and other cloud solutions.
- 2.5 Registration — the process of creating a User account in the Platform system.
- 2.6 Wallet — a payment instrument in the UzCloud system for topping up the balance and automatic payment for services.
- 2.7 Downtime — system failures due to unforeseen circumstances (cyberattacks, hardware failures, power outages, Internet disruptions).
- 2.8 Backup — a paid weekly data backup service for cloud server disks (copies from the last 4 weeks are stored).
- 2.9 Snapshot — a file containing information about the location of data on the server.
- 2.10 Support Ticket System — a communication channel for User requests to the Provider through a registered account.
- 2.11 Billing Period — the period for calculating payment for services used (Prepaid/Postpaid).
- 2.12 Gross Violation — actions threatening security: cryptocurrency mining, malware installation, cyberattacks, use of torrent networks, copyright infringement.
- 2.13 Server Data — data entered by the User within their server.
- 2.14 Inactive Status — the status of a User who has not confirmed their email or phone number.
- 2.15 Active Status — the status of a User with no outstanding debt and unrestricted access to services.
- 2.16 Suspended Status — status when payment is overdue: the Provider temporarily suspends the server.
- 2.17 Blocked Status — status when payment is significantly overdue: the server is completely deleted, access is blocked.
- 2.18 Closed Status — the status of a User who has voluntarily closed or deactivated their account.
- 2.19 Force Majeure — unforeseen circumstances beyond the control of the parties: fire, earthquake, storm, flood, war, terrorism, pandemic, government decisions, etc.
- 2.20 User — a person actively using cloud services and having an agreement.
- 2.21 Project — a grouping of cloud virtual servers into a specific category.
- 2.22 Basic Verification — identity confirmation via email and SMS.
- 2.23 Tariff Plan — a set of conditions and pricing for the provision of a service, determined by the Provider.
III. Registration
3.1. To use the Platform, users must register and verify on the official website uzcloud.uz.
3.2. During registration, users must provide all required information accurately and completely.
3.3. Each user is allowed to register with only one email address. Previously used emails and phone numbers cannot be reused.
3.4. The Platform stores personal information and server data. Login passwords, bank card details and server access credentials are not stored.
3.5. In case of lost credentials, the User can independently use the password reset form.
3.6. Registered but unverified users are denied access to services.
3.7. The following services are available to verified users:
- Virtual Server — a software analog of a physical server based on virtualization technologies
- Cloud Storage — secure storage of large volumes of data in a cloud environment
- Kubernetes (K8s) — a container orchestration platform
- Application Platform — hosting software in a reliable cloud environment
- Simple Host — PHP-based web hosting
- Marketplace — platforms for purchasing within the system
3.8. Registration for individuals:
- 3.8.1. Registration on the official website https://uzcloud.uz
- 3.8.2. Email confirmation: a verification code is sent to the specified address
- 3.8.3. Phone number confirmation: an SMS with a code is sent to the specified number
- 3.8.4. Verification via MyID
- 3.8.5. Agreement with the Offer terms and Platform access conditions
3.9. Registration for legal entities:
- 3.9.1. Registration on the official website https://uzcloud.uz
- 3.9.2. Email confirmation via a code sent by email
- 3.9.3. Completing the connection application: organization name, director's full name, TIN
- 3.9.4. A manager processes the contract through the Didox system. After signing, the user is activated
- 3.9.5. After activation, access to the Platform is provided
IV. Provider Rights and Obligations
4.1. The Provider has the right to require Users to comply with these Terms.
4.2. The Provider has the right to charge for all types of cloud services used.
4.3. The Provider has the right to immediately suspend all User services when there are insufficient funds in the account.
4.4. If the User does not pay within 5 days after server shutdown — backup copies are created and the server is deleted. If 'Resume' is not clicked within 20 days after 'Suspended' status — all data is permanently deleted.
4.5. After complete deletion of User data, it cannot be recovered.
4.6. The Provider provides snapshots and weekly backups (up to 4 copies per month), and may also offer additional paid backup services.
4.7. The Provider is not responsible for losses due to the User's failure to create backups.
4.8. In case of infrastructure failure, the Provider may take emergency measures without prior User consent.
4.9. In case of critical server security issues, the Provider suspends the server and notifies the User.
4.11. The Provider is obligated to regularly update and improve the virtualization infrastructure.
4.13. The Provider is obligated to provide Users with support via the ticket system, phone or email.
4.15. The Provider has the right to offer users paid software licenses.
4.16. For technology updates that require service suspension, the Provider notifies users at least 1 day in advance via their registered email.
4.17. The Provider has the right to offer and sell products and services presented on the Platform.
4.18. The Provider may not transfer confidential information to third parties (except as provided by the legislation of the Republic of Uzbekistan).
4.19. The Provider has the right to change tariff plans and payment terms, notifying users at least 10 calendar days in advance.
4.10. The Provider is obligated to ensure service reliability, including:
- Stable CPU and RAM operation on cloud virtual servers
- Disk space availability
- Reliable network connection
4.12. The Provider is not responsible for data and settings inside the User's server:
- Operating system stability
- Data stored in applications
- Software updates and improvements
- Program runtime environment
- Open network ports
- Data transmission security
4.14. The Provider is obligated to provide access to server monitoring, including:
- Server power status (on/off)
- CPU usage
- RAM usage
- Disk read speed
- Network traffic usage
V. User Rights and Obligations
5.1. The User has the right to require the Provider to fulfill its obligations in accordance with these Terms.
5.2. The User has the right to formally express complaints about service quality, request new products and suggest improvements.
5.3. The User has the right to submit support requests via official email, phone or other verified channels.
5.4. The User has the right to receive consultation on using and minimizing risks when working with a cloud server.
5.5. The User is obligated to pay for services on time in accordance with the Provider's invoices.
5.6. The User is responsible for maintaining the confidentiality of their credentials. All risks from transferring data to third parties are borne by the User.
5.7. The User may not use the Platform for storing, processing or distributing prohibited content: incitement to violence, war propaganda, pornography, incitement of discord, degradation of human dignity and other information prohibited by the laws of the Republic of Uzbekistan.
5.8. Upon the Provider's first request, the User must remove prohibited content within 24 hours.
5.11. The User bears responsibility for risks associated with access restrictions due to unpaid invoices.
5.12. Without backup, the User bears full responsibility for the safety of data on the server.
5.13. The User is obligated to promptly update the operating system, fix vulnerabilities and implement security measures.
5.14. Before resuming services, the User must settle all debts, including payment for backups.
5.9. The User is responsible for managing their server, including:
- Operating system reliability
- Data protection in software applications
- Software updates and improvements
- Software license currency
- Program runtime environment management
- Open network port protection
- Data transmission security
5.10. To maintain information security, the User is obligated to:
- Keep account credentials confidential
- Keep cloud server credentials confidential
- Close open network ports
- Protect the server from potential cyberattacks
VI. Payment Terms — General Provisions
6.1.1. Individuals pay for services on a Prepaid basis. Legal entities receive services on a Postpaid basis.
6.1.2. The billing period is one calendar month, tied to the first day of each month for all Users.
6.1.3. For first-time connections mid-month, the cost is calculated proportionally: A / B x C = D, where A — tariff rate, B — days in the month, C — remaining days until the end of the month, D — amount due.
6.1.4. Service costs are determined based on selected products and their technical specifications.
6.1.5. Payment is made in the national currency — Uzbekistani som (UZS).
6.1.6. The User is obligated to pay for Platform services on time.
6.1.8. If there are funds in the wallet, the monthly service payment is automatically debited.
6.1.9. Upon termination of the Agreement, unused wallet funds are non-refundable.
VI. Payment Terms — Legal Entities
6.2.1. Services are provided on Postpaid terms — payment for services already rendered.
6.2.2. Payment on an hourly, daily or monthly billing basis.
6.2.3. In the first month, payment is made within 3 banking days from the date of the Agreement.
6.2.4. For initial connection — 100% prepayment of the service cost.
6.2.5. An invoice is generated monthly and sent no later than the 5th of the following month.
6.2.6. Payment within 10 days after the invoice is issued. If overdue, the Provider may temporarily block access.
6.2.7. Payment is made by bank transfer to the Provider's account specified in the Agreement.
6.2.8. If payment is not received, service provision is suspended until payment is made.
6.2.9. When resource consumption increases, a supplementary agreement is concluded. The cost is included in the next billing period.
6.2.10. The obligation to pay remains with the User until the official termination of the Agreement, regardless of actual usage.
VI. Payment Terms — Individuals
6.3.1. Services are provided on a Prepaid basis.
6.3.2. Payment through available payment systems on the Platform.
6.3.3. Payment on an hourly, daily or monthly billing basis.
6.3.4.1. Daily billing: daily charge. If insufficient funds, access is suspended until top-up.
6.3.4.2. Monthly subscription: funds are debited in advance. The subscription renews automatically if funds are available. The subscription can be cancelled in the personal account before the start of a new billing period.
6.4.1. The User can change the tariff plan during the billing period. Recalculation is proportional to the remaining time.
6.4.2. Individuals pay for additional resources in advance. For legal entities, the cost is included in the next invoice.
6.4.3. Example: when upgrading from 1 vCPU / 1 GB RAM / 10 GB SSD to 2 vCPU / 4 GB RAM / 20 GB SSD — only the difference is paid proportionally to the remaining time (1 vCPU x 71,000 + 3 GB RAM x 10,000 + 10 GB SSD x 22,000) / remaining days.
VI. Service Suspension and Termination
6.5.1. If payment is not made before the start of a new billing period, access for individuals is automatically suspended.
6.5.2. Suspended services are automatically restored after successful funds deduction from the balance.
6.5.3. To terminate the agreement, a legal entity sends a notification to info@uzcloud.uz. The agreement is considered terminated 15 calendar days after receiving the notification.
6.5.4. Individuals can cancel the subscription or opt out of services in their personal account.
